PURPOSE

These terms and conditions (“Terms”) govern the use of credentials for non-NFL events (the “Non-NFL Event Credentials”) issued by Forty Niners Stadium Management Company LLC  (“Stadium Manager”) solely for the purpose of providing those in possession of such credential (“Credentialed Personnel”) authorized access to designated area(s) of Levi’s Stadium located in Santa Clara, CA (the “Facility”) necessary to perform their assigned duties and responsibilities associated with event(s) hosted at the Facility (each, an “Event”) for which the credential is issued.
 

AGREEMENT

By accepting and/or using a Non-NFL Event Credential, Credentialed Personnel acknowledge that they have read, understand and agree to be bound by the Terms and all other laws, rules and regulations, legal requirements, and rules and policies issued by the City of Santa Clara (the “City”), the facility manager of the Facility, Forty Niners SC Stadium Company LLC, Forty Niners Football Company LLC, Santa Clara Stadium Authority, and any Event promoter designated by Stadium Manager (each, an “Event Entity” and collectively, the “Event Entities”).
 

TERMS

A. Non-NFL Event Credentials issued by Stadium Manager provide privileged access to Credentialed Personnel to areas not accessible by the general public, solely for the purpose of performing those assigned duties that are necessary to service each Event (“Event Service Purposes”).

B. Each Non-NFL Event Credential: (a) shall clearly indicate the non-public areas in the Facility the Credentialed Personnel has been authorized to access (as determined by Stadium Manager in its sole discretion) during such applicable Event. Such access (b) will not require an admission ticket to such Event for entry into the Facility; and (c) shall expire upon conclusion of such Event.

C. Non-NFL Event Credentials may not be transferred, sold, or otherwise distributed by Credentialed Personnel, and may be used only, and directly, for Event Service Purposes. Any unauthorized use or transfer of a Non-NFL Event Credential by a Credentialed Personnel shall warrant an immediate ejection from the Event and prosecution for criminal trespass, and subjects Credentialed Personnel’s employer to the following: (a) revocation of use of future Non-NFL Event Credentials ; or (b) termination of any agreement between Credentialed Personnel’s employer and any Event Entity. Stadium Manager, at its sole discretion, may revoke any Non-NFL Event Credentials issued to Credentialed Personnel or Credentialed Personnel’s employer.

D. Credentialed Personnel and their employer shall: (a) assume all risk incident to the performance by Credentialed Personnel of their services; (b) assume all risk incident to attending the Event; (c) agree that the Event Entities shall not be responsible for a Credentialed Personnel’s use of any equipment in use in the Facility; and (d) agree to indemnify and hold harmless each Event Entity and its respective affiliates, and each of their respective officers, directors, managers, members, employees, and agents from and against all liability, loss, damage, demand or expense resulting from or arising out of the issuance of this Non-NFL Event Credential or the Credentialed Personnel’s presence in the Facility, except to the extent such liability, loss, damage or expense arises out of the willful misconduct of an Event Entity seeking indemnification.

E. Credentialed Personnel, along with their belongings, may be searched upon entry into the Facility and Credentialed Personnel consents to such searches and waives any claim they may have against any Event Entity in connection therewith. If Credentialed Personnel fails to consent to such searches, it is agreed and understood that they will be denied access to the Facility.

F. Any Credentialed Personnel who is deemed disorderly, or who fails to comply with these Terms, any term of the Levi’s Stadium Code of Conduct Policy, or any or all security measures, shall be, if appropriate, ejected from the Facility and prosecution, and shall subject Credentialed Personnel’s employer to the following: (a) revocation of such Credentialed Personnel’s or employer’s use of future Non-NFL Event Credentials; and (b) termination of any agreement between Credentialed Personnel’s employer and any Event Entity. G. Non-NFL Event Credentials are non-transferrable and may only be used by the individual to whom one is issued.

H. Non-NFL Event Credentials do not have a cash value.

I. Non-NFL Event Credentials are void if reproduced, copied, transferred, distributed, purchased, traded or sold and where otherwise prohibited or restricted by law.

J. Posting Non-NFL Event Credentials on any social media platform is strictly prohibited.

These Terms are subject to change from time to time at Stadium Manager’s sole discretion.
